These GTC govern sales made through the website https://fondue-welsch.ch.
Article 2 – Scope
These GTC apply to any order placed on the website. By confirming their order, the customer acknowledges having read and accepted them without reservation.
Article 3 – Products
The products offered are described with the greatest care. Photographs are provided for illustrative purposes and are not contractual. Ingredients, allergens, nutritional values and storage conditions are shown on the packaging and, where available, on the product sheet.
Article 4 – Availability
Products are offered subject to available stock. If a product becomes unavailable after the order, the customer will be informed as soon as possible and may choose between a refund, a postponement or a replacement solution where offered.
Article 5 – Prices
Prices are shown in Swiss francs (CHF), including VAT where applicable.
The applicable prices are those displayed at the final confirmation of the order.
Delivery charges are calculated automatically based on weight, destination and the selected delivery method. They are displayed before the final confirmation of the order.
In the event of an obvious pricing or description error, the seller may cancel the order and fully refund the amounts collected.
Article 6 – Order
The contract is concluded when the customer receives an order confirmation after payment has been validated.
Before confirming their order, the customer must check that the information entered is correct. Any costs resulting from an input error or an incomplete address remain the customer's responsibility.
When an order is shipped directly to a third party (gift), the customer remains responsible for the accuracy of the information provided about the recipient.
The seller reserves the right to refuse or cancel an order, in particular in the event of a declined or unauthorised payment, suspected fraud, an obvious error, product unavailability, an unusable address or any other reasonable impossibility of fulfilling the order. Any amounts collected are then refunded.
Article 7 – Payment
Payment is made exclusively online at the time the order is confirmed.
Payments are secured by Payrexx AG. Mon Producteur Sàrl never has access to the complete payment details.
Article 8 – Delivery
Orders are generally shipped within 3 to 7 working days. Delivery times are indicative only.
A reasonable delay does not give rise to any claim for damages.
The seller may make a partial delivery where circumstances require. No additional charge will be billed to the customer in this case.
Article 9 – Collection in Martigny
Where collection is offered, the practical arrangements and opening hours are available on the "Contact" page of the website.
Article 10 – Transfer of risk
Risk in the goods passes to the customer upon their handover to the carrier, unless mandatory provisions of Swiss law provide otherwise.
Article 11 – Refrigerated products and cold chain
Products are shipped in packaging suitable for transporting refrigerated foodstuffs.
The customer must take receipt of the parcel as soon as possible and immediately place the products in the refrigerator.
In the event of absence, an incorrect address, an uncollected parcel or any circumstance attributable to the customer that breaks the cold chain, the seller declines all liability as to the quality of the products.
Article 12 – Right of withdrawal
Swiss law does not provide for a general right of withdrawal for distance sales. Confirmed orders are therefore firm and final, unless otherwise provided in these GTC.
Article 13 – Returns and complaints
Foodstuffs, refrigerated products, opened products or products whose cold chain has been broken can be neither returned nor exchanged, except in the event of a proven defect or a delivery error attributable to the seller.
Any complaint must be submitted as soon as possible, together with the order number and photographs of the problem observed.
Article 14 – Warranty
The seller warrants that the products correspond to the order at the time of transfer of risk. The warranty does not cover defects resulting from improper storage, improper handling or a break in the cold chain attributable to the customer.
Article 15 – Retention of title
The goods remain the property of Mon Producteur Sàrl until full payment has been made.
Article 16 – Force majeure
The seller cannot be held liable for any delay or non-performance resulting in particular from a natural disaster, a pandemic, a decision by the authorities, a strike, a major breakdown, a cyberattack, a shortage or the unforeseeable failure of a supplier or carrier. Obligations are suspended for the duration of the event.
Article 17 – Data protection
Personal data is processed in accordance with the Privacy Policy published on the website.
Article 18 – Intellectual property
All content on the website is protected by intellectual property law.
Article 19 – Severability
If any provision of these GTC is declared invalid, the remaining provisions remain applicable.
Article 20 – Governing law and jurisdiction
These GTC are governed by Swiss law. Subject to the mandatory places of jurisdiction provided by Swiss law, the competent courts are those of the registered office of Mon Producteur Sàrl.
